ADOPTION, CUSTODY AND RECOGNITION OF PATERNITY

In cases of supporting adoption procedures, custody and recognition of paternity, common to cases of "adopted children " that did not undergo regular adoptions.

INTERNATIONAL ADOPTION


The adoption procedure had suffered deep changes with the advent of law n. 12.010/09, mainly in international adoption.
The requirement of a lawyer to carry out the international adoption, and the increase of the adaptation period are not the only formalities to be followed.  Those who wish to carry out an international adoption of Brazilian children, need to take some steps:

HAGUE CONVENTION AND PRIOR AUTHORIZATION

With the ratification by Brazil, of Hague Convention, of May 29th 1993, the foreign that is interested in adopting a brazilian child must be represented by an authorized foreign entity, the one, accredited in your home country and in Brazil.

The Supporting International entities also should be registered in CEJA, showing the following documents:

a) Document that proofs the entity registration with the Central Administrative Federal Authority
b) the rules that created and regulated the statutes or equivalent constitutional documents;
c) proof of official authorization to operate in the country of origin, if private institution;
d) briefing or equivalent document, identifying those responsible for institution;
e) legislation dealing with adoption in their home country, duly translated and with proof of its validity.

IMPORTANT: The institution, when applying to registration, Will assign a person resident in Brazil that Will be representing the one, the authorization procedures of those institutions will follow the same framework of requests to authorization of interested in adoption. AUTHORIZATION IN CEJA

Every international adoption Will be processed in Santa Catarina right after the authorization of those interested in the Comissão Estadual Judiciária de Adoção – CEJA by showing the following documents:

  • Document issued by competent authority of respective country, proofing to be authorized to adopt the laws of your country;
  • Biopsicossocial study prepared at the residence of the applicants;
  • Certificate of Criminal History;
  • Certificate of Physical and Mental health;
  • Marriage Certificate;
  • Passport;
  • Statement of Income;
  • Certificate of Residence;
  • Relevant legislation text on international adoption of the country of residence or domicile of applicants with their proof of validity;
  • Statement of Knowledge obtained at the link below;
  • Requeriment obtained at the link below;


IMPORTANT.: All documents in foreign language must come authenticated by the consulate authority, along with their translations, done by a sworn translator. When in photocopies, these must be authenticated.

NEXT STEPS


After the approval it will be forwarded to the childhood and youth court in order to create an application to the court's adoption judgment. It is mandatory the presence of an attorney.
